Bargaining Unconscionability

Also known as procedural unconscionability, this is a grounds by which a prenuptial agreement may be invalidated. It occurs when there is such a strong bargaining imbalance between the parties due to differences such as age, intelligence, and education that the prenuptial agreement cannot be given legal effect.
